The Federal Supreme Court rejected the challenge to the constitutionality of a text regarding the seat distribution system for provincial council elections. The court’s media stated, in a statement: “In accordance with the jurisdiction of the Federal Supreme Court to monitor the constitutionality of applicable laws and regulations, the court considered an appeal related to the constitutionality of a text in Seat distribution system for irregular governorate council elections in the region No. (9) of 2023 issued by the Independent High Electoral Commission. He added, “This came during the court session held on 24/3/2024 when it considered the case filed before it in the number (Federal 56 2024) to challenge the constitutionality of the text of Article (3 Thirds 5) of the aforementioned system, which stipulates: If there remains one seat allocated for women (quota) and it is... There are lists that won three seats, two seats, or one seat, and there was no winning woman among them, so the replacement from the lists that won three seats, two seats, or one seat will be for a female candidate who received the highest votes among the women on these lists and did not win a seat, and she will be replaced by a winning candidate from among those lists. He continued, "The court issued its final ruling that is binding on all authorities, according to which it decided to reject the appeal because the contested text was consistent with the provisions of the Constitution and does not violate any of its provisions."[/size]
