[size=45]On Tuesday, the Council of Ministers held its second regular session this week, headed by Prime Minister Mohammed Shia Al-Sudani, to compensate for the session that was postponed due to the Eid Al-Adha holiday.[/size]
[size=45]The Prime Minister's Media Office stated in a statement that "Al-Sudani chaired the twenty-sixth regular session of the Council of Ministers, which is the second during this week, to compensate for the session that was postponed due to the Eid al-Adha holiday. The session witnessed the discussion of all general topics in the country, and the follow-up of service and economic files, especially those related to the implementation of the government program. The items included on the agenda were also discussed, and the necessary decisions were taken regarding them."[/size]
[size=45]During the session, the Prime Minister directed “the formation of a committee from the Investment Authority, the Council of Advisors in the Prime Minister’s Office, the Governorate Affairs Coordinator, and the Legal Department in the General Secretariat of the Council of Ministers, to study the proposed amendments to the investment system.”[/size]
[size=45]He also directed, according to the statement, "the ministries to activate the memoranda of understanding that were signed with Turkey during the visit of Turkish President Recep Tayyip Erdogan to Iraq."[/size]
[size=45]Within the framework of the government’s treatment of the electricity file and the development of direct solutions, approval was given to “the Ministry of Electricity contracting with private sector companies to provide an additional amount of energy, due to the summer peak load, using the (Take and Pay) method, according to the equation proposed by the Ministry of Electricity, for a period of 3 months, extendable according to the system’s needs, and according to financial powers.”[/size]
[size=45]As well as approving “the exemption of the Oil Products Distribution Company, for the purpose of contracting with a tanker company to transport operational fuel to private sector stations; to enable the commencement of transporting fuel as quickly as possible, and to begin preparing electrical energy for the national system.”[/size]
[size=45]Based on the government’s approach to completing lagging projects, and to prevent wasting public money, the Council of Ministers approved the following:[/size]
[size=45]First: Changing the name of the project (Rehabilitation of the original Khalidiya Unified Water Project with a capacity of 250 m3/hour in Anbar Governorate/ World Bank emergency loan/ Additional financing), to become (Rehabilitation of the original Khalidiya Unified Water Project with a capacity of 250 m3/hour, and the expansion with a capacity of 200 m3/). An hour in Anbar Governorate/emergency loan - additional financing), with an increase in the total cost of the project.[/size]
[size=45]Second: Creating a component (completing the establishment of scientific departments in the Technical Agricultural College/University of Mosul), and increasing the total cost of the project.[/size]
[size=45]In order to complete the requirements of the strategic joint seawater project, the recommendation of the Ministerial Council for Energy (24054 T) for the year 2024 was approved as follows:[/size]
[size=45]1. Excluding the joint seawater project tenders and the project consultant tender (CSSP) of ILF Company from the contracting methods stipulated in the Government Contracts Implementation Instructions (2 of 2014) and excluding them from the application of the standard document.[/size]
[size=45]2. Excluding the tenders for the Joint Seawater Project and the tender for the Project Consultant (CSSP) ILF Company and the consultants from the instructions to facilitate the implementation of the federal general budget for the years (2023-2024-2025).[/size]
[size=45]3. The project is included in the aforementioned paragraphs (1 and 2) of Cabinet Resolution (23700 of 2023).[/size]
[size=45]Within the framework of the government’s special work to care for heritage landmarks, the Council approved the recommendations of the Joint Committee for Heritage Schools, as stated in the Ministry of Education’s letter dated November 27, 2023, as follows:[/size]
[size=45]1. Referring the two schools (Al-Futowa and Quraish) to demolition and reconstruction, in the traditional form and style specified by the joint committee.[/size]
[size=45]2. Including Al-Kadhimiya Elementary School, Al-Mufid Elementary School, Al-Kadhimiya Intermediate School for Boys, and Al-Kadhimiya Intermediate School for Girls in maintenance and restoration work.[/size]
[size=45]3. Coordination between the Ministry of Education and the Ministry of Finance to provide the required amounts for (12 schools) included in the plan to develop the holy city of Kadhimiya, by carrying out the required transfer in accordance with the Federal General Budget Law for the fiscal years (2023 - 2024 - 2025).[/size]
[size=45]In the course of the government’s policy under the auspices of all components in Iraq, the Council voted on the following:[/size]
[size=45]First: Approval of the recommendation of the Ministerial Council for Social Services (24018 Kh) regarding the transfer of ownership of the properties whose details are listed below to the Endowments Office of the Christian, Yazidi, and Mandaean Religions, as follows:[/size]
[size=45]1. Transfer of ownership of real estate (2/6716 Al-Katun - Diyala/Mandaean community center), (10/2 Al-Sikkah and Al-Kaf/Muqdadiyah - Diyala Mandaean community cemetery), (1/473 Khasah Timari - Kirkuk Mandaean community center) without compensation, based on the provisions of the Religious Endowments Office Law (58 of 2012).[/size]
[size=45]2. Transfer of ownership of real estate (2/456 Al-Khar/Baghdad Mandi of the Sabian-Mandaean sect), (48/24 Abu Tararid Al-Diwaniyah, cemetery of the Sabian-Mandaean sect), (34/3 Al-Zubayr/Basra, cemetery of the Sabian-Mandaean sect) without compensation, based on the provisions of the Ownership Law Piazzas and Buildings (3 of 1960).[/size]
[size=45]3. The Minister of Construction, Housing and Municipalities shall transfer the ownership of the two properties (180/54990/Al-Nasiriyah, Mandaean Sabean Cemetery), (1/123 Souq Al-Shuyukh/Al-Nasiriyah, Mandaean Sabean Cemetery) without compensation, based on Legislative Resolution (693 of 1973).[/size]
[size=45]4. Transfer of ownership of the property (13/430 Al-Karkh/Baghdad) for a fee, based on the provisions of the amended Law on the Sale and Rent of State Funds (21 of 2013).[/size]
[size=45]Second: The transfer of ownership above shall be in accordance with what is stated above, restricted by the conditions of endowment lands, with a commitment to the uses of the lands without changing them.[/size]
[size=45]Third: The Ministry of Finance shall, within (30) working days, maximum from the date of issuance of this decision, submit a study to the Council of Ministers to settle the rights arising from the two properties numbered (3/6578 Waziriya/Baghdad Social Club), and (1/Al-Sayyada/Kirkuk Cemetery of the Mandaean Community), and to state the extent of the possibility of transferring their ownership to the aforementioned Diwan.[/size]
[size=45]In support of the government for the work of the private sector, paragraph (4) of the recommendation of the Advisory Board was approved, regarding addressing the problems and obstacles to work in the private industrial sector, which includes taking the necessary measures to grant a period of (6) months to all industrialists who have previous debts to any government agency, to review and settle the debts and benefit from Cabinet Resolution (23188 of 2023), and failure to pay debts within a period of (6) months is not considered an obstacle to promoting their transactions.[/size]
[size=45]This decision shall be implemented from the date of its issuance.[/size]
[size=45]In the field of health care and its projects, the Council of Ministers approved what was stated in the letter of the Ministry of Health dated June 27, 2024, excluding Nineveh Governorate from the instructions for implementing government contracts (2 of 2014), and granting the Governor of Nineveh the authority to direct a direct invitation to a consulting office for the purpose of auditing and approving designs, and supervising. To implement the (Ibn Sina Teaching Hospital) project, implemented within the emergency support budget.[/size]
[size=45]Approval of what was stated in the letter of the Ministry of Health regarding the settlement of the amounts related to the commitment agreement for Iraq with the COVAX facility, which was cancelled in exchange for paying the termination fees for the agreement with the manufacturers (GAVI), as all amounts due to Iraq are paid in one payment within 20 days of notifying (GAVI) of that, provided that the payment is 78.5% of the total amount due, which is equivalent to 6.546 million dollars, according to the Global Alliance for Vaccines and Immunization voluntarily.[/size]
[size=45]The Council of Ministers approved the recommendations of the Diwani Order Committee (23603), which was formed under the direction of the Prime Minister, in light of what was presented in the session held on June 4, which included reconsidering the lawyers’ fees stipulated in the Law on the Law (173 of 1965), amended, to become According to the following:[/size]

[size=45]B. Not less than (25 thousand dinars) only, and not more than (150 thousand dinars) in the lawsuit of unlimited value, and the criminal lawsuit in which there is a civil plaintiff.[/size]
[size=45]C. An amount of (5%) of the value of the consideration awarded in expropriation claims, provided that it is not less than (25 thousand dinars) only, and not more than (150 thousand dinars).[/size]
[size=45]D. Not less than (25 thousand dinars) only, and not more than (75 thousand dinars), borne by the state treasury for the appointed attorney in accordance with the provisions of Article (144) of the Criminal Procedure Code (23 of 1971).[/size]
