Legal expert: Al-Zarfi does not need an absolute majority in the House of Representatives
The legal expert, Tariq Harb, confirmed that the Prime Minister-designate Adnan Al-Zorfi does not need an absolute majority to vote for his government in the parliament.
Legal expert Tariq Harb told PUKmedia: The constitutional quorum for the parliament session will be attended by 165 representatives, the least of whom are more than half of the 329 members of the House of Representatives.
He added: But the granting of confidence occurs by a majority of those present, so if the attendance is 180 members, then granting confidence to Al-Zrafi is only 91 deputies according to the fourth paragraph of Article 76 of the Constitution, which stipulated an absolute majority of the attendees and not the majority of the members who are 165 members, out of a total of 329.
Harb explained: The withdrawal of confidence is with the consent of an absolute majority of the members according to paragraph 3 / VIII / 61 of the constitution, meaning that the constitution stipulated an absolute majority only when granting confidence, but it required an absolute majority of the members when the confidence was withdrawn, thus having 165 members in the session, for example, achieve a quorum and a vote The approval of 83 deputies in favor of Al-Zarfi is sufficient to give confidence. The fact that this number constitutes the absolute constitutionally determined majority of the 165 representatives present, that is, more than half of the quorum of the attendees, as the constitution tolerated trust in terms of the required number, while the constitution tightened the withdrawal of confidence, as it required an absolute majority of the members who are 165, thus granting Confidence for Zarrafi is easy in terms of the required number of representatives.
