Calls to form a judicial body to legislate laws

Political experts have pointed out the complexities of introducing controversial laws inside the House of Representatives at such a time, and the extent of the Council’s ability to address crises despite the passage of two decades of the democratic experience in Iraq. They have suggested forming or electing a judicial and legal body that would be a parallel to the state’s formations and take upon itself the task of legislating laws, and that they would then be passed to the two councils (ministers and representatives) for approval, in order to save time and also to resolve controversial laws.
Political analyst Ali Al-Baydar said in an interview with Al-Sabah: “The Iraqi legislator still looks at the laws and the extent of their danger to society in a superficial way, in light of his practice of other tasks related to forming the government, voting on the three presidencies and the supervisory aspect, and the period allocated for legislation in each electoral cycle seems small and insufficient, in addition to the lack of sufficient maturity to choose the laws and their contents.”
He explained that "most of the controversial laws proposed do not cover the public interest or the sovereignty of the state, which the Iraqi constitution emphasized, and may not be compatible with the principles of human rights or the sacrifices made by Iraqis, or are partly related to a certain type of modernity and development that the world has reached." Al-Baydar suggested "electing a legal and judicial body that would legislate and pass laws in stages; the first of which would be the Council of Ministers to vote on them, and then the House of Representatives to approve them, and that the objection - if any - would be to specific articles in those laws, and thus we would gain time to secure new laws instead of occupying the two councils, the ministers and the representatives, with the process of preparing, legislating and writing laws that concern society and the state."
In turn, political analyst Omar Al-Nasser said in an interview with Al-Sabah: “The failure of the House of Representatives to address laws that require strict legislation for issues may lead to a direct threat to security and societal peace, and the incitement of sectarian strife, which increases the disintegration of society, not to mention some controversial decisions that do not serve the national interest and common interests through moral commitment to the constants of national unity.”
He stressed that "strict and bold decisions must be taken to actually implement the codes of honor that were put forward after 2003, in addition to preserving and empowering Iraqi sovereignty, curbing corruption and waste of public money, and enacting a law that serves and does not destroy the infrastructure, instead of going into controversial matters that do not fatten or satisfy hunger except for partisan and electoral gain and achieve nothing but the gains of reaching power."
Al-Nasser called on the House of Representatives to assume its “historical role and responsibility in involving the street and public opinion in the pivotal and essential sensitive national issues, in which the role of the representative may not be sufficient to make a fateful decision on behalf of his voters. Rather, it is possible to go to a public referendum to know the real decision emanating from the depth of the public, instead of placing the responsibility only on the shoulders of the honorable representatives, whom their voters may hold responsible for future decisions.”
