    Baghdad / resource news
Today, Sunday, the legal expert, Ali Al-Tamimi, separated articles related to the dissolution of the Accountability and Justice Commission.
    According to Tamimi:
    - Article 135 second of the constitution stipulates that the House of Representatives dissolves the Accountability and Justice Commission after completing its work by an absolute majority.
    - When referring to the law of this body No. 10 of 2008, Article 19 of it required that this body submit a quarterly report to the House of Representatives on the measures it took, being that this body is linked to the House of Representatives and subject to its oversight, so it is obligated to notify the House of Representatives whether it has completed its work or not The House of Representatives may also inquire about it by virtue of Article 19 of the law on this body, i.e. accountability and justice.

    - Article 24 of the Accountability and Justice Commission Law obligates this commission to prepare an archive of the persons covered and their jobs and refer it to the Council of Ministers so that the latter can circulate it to government agencies and organizations and this is in order not to appoint them again..and so that the Council of Ministers works by virtue of Article 135 of the Constitution by notifying Parliament By the end of the work of this body, that is, in coordination.
    - Article 25 of the Accountability and Justice Commission Law said that the House of Representatives dissolves the Accountability and Justice Commission by an absolute majority of the number of members after confirming through the quarterly reports submitted by the Commission to the House of Representatives, as we said, and the coordination of judges and employees is terminated, and employees are placed in state departments.
    - The dissolution of the Accountability and Justice Commission here does not need to enact a new law because the method of dissolution was drawn by the legislator with all the procedures in the Commission’s Law No. 10 of 2008 in force. Therefore, if the House of Representatives decides to dissolve, then this decision is an extension and complement to the legal procedures drawn up by Law No. 10 of 2008 and is considered an extension For this law, which kept the issue of dissolution open, and by dissolving this body, the law ends due to the existence of Article 25 of the above law, which permitted this.
The legal expert explained: “If the legislator wanted to terminate the commission’s work with a new law, he would stipulate that, but he set the procedures after the dissolution and left the details to the House of Representatives in the voting decision, in other words, the decision to dissolve the Accountability and Justice Commission from parliament is considered an extension of Law No. 10 of 2008, which kept the same It is open until a vote on the dissolution decision, given that the commission’s work is transitional and temporary.”
