    The academic researcher, Yahya Al-Kubaisi, criticized the "bad content" campaign recently launched by the Ministry of Interior on social media platforms, indicating that it is possible to pursue "Al-Jahiz's messages" and Saadi Youssef's "Erotica" as part of this ministry's campaign.

    Al-Kubaisi said in an analytical article in “Al-Quds Al-Arabi” followed by “Nas” (February 10, 2023), that “reading the text of the legal article that was adopted here means that it is possible to judge any Iraqi who” possessed or achieved “in his library” the “Erotica” collection. by the great poet Saadi Youssef, which includes “erotic” drawings by the Iraqi artist Jabr Alwan, as a “book” that includes “drawings” that are indecent and public morals!     He added, "In a previous article entitled "Totalitarian Laws Expose the Myth of Democracy," we talked about the survival of laws that were legislated under totalitarian regimes that continue to run out in post-2003 Iraq, and that no one sought to amend or cancel these laws, given that they are no longer valid for work. In the context of a supposed democratic system!  
      
    Al-Kubaisi continued, "Thus, the system of government in Iraq succeeded in emptying the content of the constitutional texts that talk about guaranteeing" freedom of expression "and that it is considered null and void" every legal text that contradicts it" and that the legal limitation and restriction should not affect "the essence of the right or freedom" not through The laws in force that fundamentally contradict the constitutional text, but rather through the excessive interpretation of the legal articles in force also to further confiscate freedom of expression!  
      
    The academic researcher pointed out, "The essential question here is, why did the Ministry of Interior or the Public Prosecutor not move to implement the law over the past years, and let the phenomenon of inappropriate content turn into a real phenomenon, if they actually believe that they are legally 'assigned' to this duty? As long as they don't want to admit that there is a legal vacuum in dealing with social media content in Iraq!"  
      
    He explained, "Going back to the origin of the story, we will find that the 'content creators' scandal that erupted during the Arab Gulf Championship that Basra received last month, that the need for a 'media show' to cover up the way in which the scandal of theft of the century was managed, is the only one behind this. The last campaign, and that this campaign will stop at this limit of media distortion, and those who have been sentenced will only be scapegoats, because many of the “makers” of this content enjoy the same immunity as money launderers, smugglers and investors in public money!  
      
    And between Al-Kubaisi, “A few days ago, content makers were arrested on social media, and by following up the facts of the case of one of these, we found that there was a letter issued on January 25, 2023 by a committee called the “Bad Content Follow-up Committee” affiliated with the Ministry of Interior. An investigative judge of the Third Karkh Court, who specializes in publishing and media issues, talks about a television interview of one of the content creators. I passed it!” And he talks about “video clips that include dancing with explicit sexual overtones and immoral.”  
      
    The academic researcher pointed out that, “On February 7, the Karkh Misdemeanor Court issued a decision ruling the content creator herself to six months in prison based on the provisions of Article 403 of the Penal Code for the crime of “making and publishing several films and videos that include [sic] obscene and obscene statements.” With modesty and public morals, it was announced and presented to the public.  
      
    Al-Kubaisi stressed that "reviewing the ruling decision document reveals first that the complainant in this case is the 'public right'!" We knew that the Ministry of Interior does not have the right to initiate public right cases, and therefore it was necessary to resort to the Public Prosecution for that!
