the head of the Customs Authority, revealed the closure of the widespread corruption of customs exemptions in investment and industrial projects, and the “judicial” prosecution of owners of violating projects in order to recover customs duties. At the same time, he pointed out that the Kurdistan region does not adhere to federal decisions regarding customs work.
The advisor to the Ministry of Finance and head of the Authority, Hassan Hamoud Al-Ugaili, said in an interview with “Al-Sabah”: “The violations that accompanied customs exemptions for the first ten years of approved investment projects have greatly decreased to the degree of (zero) and in an unprecedented manner,” noting that “the procedures of the audit team The customs exemption requests formed by the Council of Ministers in March 2023 come after the role of our body through inspection committees to detect and verify the arrival of consignments to the correct place, as well as the extent of the use of raw materials in production in the quantities and types described in the
customs declaration.
He added, "The customs inspection committees seized a number of fictitious projects present on the papers, and others were empty structures of exempted imported equipment," revealing that "the owners of the fictitious violating projects that are empty of production equipment are being prosecuted judicially in order to recover the customs duties and impose a fine estimated at five times the estimated customs duty." According to the customs law imported during the past period, in addition to stopping accepting requests from these factories and prosecuting them for the crime of smuggling.”
Al-Ugaili pointed out that “the audit team is permanently present at our authority’s headquarters, and its management has become limited to the Financial Supervision Bureau in cooperation with the relevant departments in our authority with very high efficiency and experience, which has helped us limit smuggling operations with investment licenses and industrial development books, putting their needs on their correct paths, and not exploiting materials.” Exemption for sale in the parallel market, in addition to encouraging national industries to operate their factories and compete with imported products at reasonable prices.”
Regarding eliminating smuggling gangs and circumventing the law, the head of the Customs Authority explained that “next week will witness the launch of work in the Al-Sadd control and the Bawa Mahmoud control in the Nineveh and Diyala governorates to audit data on goods and materials imported through the region’s official ports,” indicating that “those controls are a basis for preventing entry into the country.” Smuggled materials and goods that violate the law in order to protect the national economy and society and its health safety from the scourge of smuggling harmful materials, whether for the benefit of investors, merchants or consumers, as well as dangerous and prohibited materials, especially medicines and foodstuffs.
He pointed out that "the Authority is waiting for the supporting authorities to complete the technical and electronic equipment, as well as matters related to infrastructure, which are expected to be completed within approximately ten days."
As for the conflict of the region’s customs decisions with the federal customs law, the head of the authority stated that “the region recognizes the application of the customs law, but it does not adhere to other federal decisions issued to regulate customs work in all ports of the country,” explaining that “the region’s authorities do not adhere to the agricultural calendar issued by the Ministry of Agriculture.” The Federal Ministry justified this by the lack of understandings between the Federal Ministry of Agriculture and
the region’s agriculture.”
He stated, "The regional authorities did not provide the Federal Customs with customs data, but our authority and the Regional Customs reached advanced understandings, which we hope will help enhance cooperation and commitment to the Federal Customs Law."
Regarding the project to link the Authority with the state departments concerned with the ESCUDA system, Al-Ugaili pointed out that “our authority at the current stage is providing the supporting departments with disks containing customs data, and in the next stage all of these departments will be linked to the ESCUDA system after it transforms into the single window system for foreign trade, which will reduce time.” The effort and cost are on our authority and the merchant, and the authority is in the process of carrying out similar procedures to link the Central Bank to the ASYCUDA automation system for the purposes of providing the Central Bank with the customs declaration for importers for the purposes of their entry into the foreign currency auction,” explaining that “the Authority will adopt a three-page paper declaration instead of the previous one, authenticate it electronically and send it via the system.” Automation.”
