Federal Court appeals against the Electoral Commission

     Baghdad / Range

The Federal Court on Sunday filed a lawsuit filed by parliamentary parties to challenge the newly elected council of the Electoral Commission. The Court considered the nomination of political blocs to some members of the Commission does not constitute a violation of the Constitution. At the end of last October, the House of Representatives voted on 9 candidates for the Commission's board, one month after the expiration of the old UNHCR's mandate last September.
"The Federal Supreme Court held its hearing and considered the appeal against the unconstitutionality of Article 3 (II) of Chapter III of the Commission's Law," said Ayas Samok, the court's official spokesman. "The appeal was focused on the establishment of a committee of the House of Representatives nominated members of the Board of Commissioners on the grounds that this constitutes a violation of the provisions of the Iraqi Constitution."
Article 3 / II stipulates that: The Board of Commissioners shall consist of nine members, at least two of whom shall be elected by a majority of the House of Representatives after being nominated by a committee of the Chamber of Deputies. They shall be competent, experienced and experienced in competence, integrity and independence, .
The court spokesman pointed out that the latter "found in its decision of (7/11/2017) No. (88 / Federal / 2017) that the committee formed by the House of Representatives, which has nominated the members of the Board of Commissioners, provided for in Article (9 / II) Of the law of the Independent Electoral Commission, and that their nomination was to fulfill their obligations under the said law, "pointing out that" the appellant was based on that the members of the Commission of the owners of special grades that need to be nominated by the Council of Ministers. "
Samok said that "the decision of the court said that this nomination does not intersect with the provisions of the Constitution; because the candidates are not the owners of special grades or agents of the ministry, but enjoy their privileges without the above mentioned, and accordingly the court found that the lawsuit is not based on a bill of the Constitution decided to respond.
