Source: Saleh addressed the Federal Court to prevent Al-Halbousi from serving as President of Iraq
And the presidency of the Iraqi Council of Representatives decided earlier today to open the door for candidacy for the post of President of the Republic, starting from Wednesday, February 9, 2022, for a period of (3) days.
On Monday, the Iraqi Council of Representatives failed to elect a new president for Iraq after most of the parliamentary blocs boycotted the session due to differences over this position, and over naming the largest bloc that would result in the formation of the next federal government.
The source told Shafaq News Agency, "Saleh's address to the Federal Court regarding the (constitutional vacuum), came after attempts to take over the Speaker of Parliament, Muhammad al-Halbousi, the duties of the presidency, on the pretext of this emptiness, and the end of Saleh's role, after entering this void."
He added, "Saleh sent this inquiry in order to block the way for Al-Halbousi to take over the presidency of the republic during the next stage temporarily, in addition to his current position as the presidency of the Iraqi parliament."
According to a document circulated today, Barham Salih submitted a request to the Federal Court, in which he stated, “Due to the fact that the House of Representatives, in its fifth session, completed the requirements of Articles (54 and 55) of the Constitution, and did not complete the requirements of Article (70) of the Constitution regarding the election of the President of the Republic due to lack of a quorum. The legal set out by your esteemed court pursuant to its decisions No. (7 and Consolidated 9 and 10 / Federal / 2022), and (16 / Federal / 2022) on 2/3/2022, in the session 7/2/2022.
In the text of his request, Saleh also requested “the interpretation of Article (72/second), as the text did not deal with the case of the parliament’s inability to fulfill the constitutional requirement contained in Paragraph (Second) above and to deal with the situation with regard to the President of the Republic exercising his duties in order to avoid a constitutional vacuum, and until the completion of The requirements of Article (70) of the Constitution.
