    Shafaq News/ Fahmi Burhan, head of the Kurdistan Regions Authority outside the Kurdistan Region administration, announced on Tuesday the filing of a judicial complaint against the Ministry of Defense, specifically the Iraqi army, on charges of committing constitutional violations and interfering in the work of the state and citizens’ affairs by storming and stationing it in the “Nawroz” neighborhood in Kirkuk Governorate.
    This came in a press conference held by Burhan with representatives of the neighborhood after meeting with them and listening to their demands, at the authority’s headquarters in the city of Erbil, the capital of the Kurdistan Region.
    Burhan said in a joint press conference held with those representatives that this file (unregistered lands) is not limited to Kirkuk Governorate only, but also exists in southern and central Iraq, and has been fully addressed, calling on the federal government to deal with Kirkuk with the same thought, and it should not be The government has a vision for the regions of southern and central Iraq for the same problem that is different and contrary to the constitution for other regions of the country.
    He added that a legal complaint had been registered about the unconstitutional interference in the affairs of the state and citizens committed by the Iraqi army in the “Nawroz neighborhood,” adding: We in the Kurdistan Regional Government and in the Commission fully support this complaint, expressing his hope that the complaint will take its legal course so that it will become clear to the Iraqi people. what happened.
    A decision by the Iraqi Ministry of Defense caused a popular crisis and a sit-in in the Newroz neighborhood in Kirkuk Governorate.
    A Shafaq News Agency correspondent reported that residents of the Newroz neighborhood, south of Kirkuk, set up sit-in tents last Saturday, in rejection of the Iraqi Ministry of Defense’s decision to evacuate the neighborhood and return ownership of the neighborhood to the ministry.
    He stated that the neighborhood was previously called “Officers’ Neighborhood” and was inhabited by army officers before 2003, and after the fall of the previous regime, the officers left it and residents lived in it, revealing that many of the floors in the neighborhood had been purchased after paying their price to their owners, the officers, earlier.
    The neighborhood includes about 140 houses, each house ranging in size from 300 to 400 square metres.
    The reporter stated that the army forces were present in the neighborhood to implement the decision of the Iraqi Ministry of Defense to restore ownership of the neighborhood to the Ministry of Defense and evacuate it from the residents, but they refused to evacuate the homes and set up sit-in tents in rejection of the decision, which they considered to be the displacement of hundreds of families.
    The winning candidate for membership in the Kirkuk Provincial Council for the Kirkuk (Our Strength and Our Will) coalition, Ahmed Kirkuki, appealed last Wednesday to the Prime Minister and Commander-in-Chief of the Armed Forces, Muhammad Shia al-Sudani, to issue a decision requiring the Ministry to wait for the evacuation of the “Nawroz” neighborhood, which is inhabited by a Kurdish majority. Iraqi Defense.
    Kirkuki said during a press conference: “We ask the Prime Minister to intervene in solving the problem and alleviate the suffering of citizens by selling those homes to them in accordance with the law, and also not allowing those homes to be withdrawn by the Ministry of Defense, because this action is illegal and is a clear violation of human rights.” At the same time, it is in violation of the constitution and the law because the residents are Iraqi citizens first, and because they were deported from the time of the former regime and were forcibly displaced second, and they returned to their city to live on their land and the land of their fathers and grandfathers.”
    Kirkuk is one of the disputed areas between Erbil and Baghdad covered by Article 140 of the Constitution, and it was subject to a joint authority between the Kurdistan Region and the federal government before the independence referendum held by the region in September 2017.
    Article 140 stipulates the removal of demographic policies conducted by Saddam Hussein’s regime in the disputed areas in favor of the Arabs at the expense of the Kurds, and then a census of the population before the final step, which is holding a referendum according to which the population determines whether they wish to join the Kurdistan Region or remain under the administration of Baghdad.

    In 2019, the Federal Supreme Court ruled that Article (140) of the Constitution of the Republic of Iraq remains in force, stressing that this continues until its requirements are implemented and the goal of its legislation is achieved.
