The Federal Court clarifies the nature of its mission and neglects to describe Iraq as “federal”

The Federal Supreme Court affirmed that its mission is the correct implementation of the Iraqi Constitution, noting that exercising this role guarantees “the unity of Iraq and the building of a democratic republican, representative, parliamentary system,” without addressing the description of Iraq as “federal” or “federal” stipulated in the Constitution.
The court stated in a statement published on its website, “The purpose of the Federal Supreme Court exercising its jurisdiction is the correct application of the Constitution, ensuring the unity of Iraq and building a democratic republican, representative, parliamentary system, based on the peaceful transfer of power and fair distribution of wealth, in addition to other constitutional foundations.” For the purpose of building the state in a way that achieves justice, removes injustice, preserves public funds and uses them for the benefit of the people, and achieves the rule of law.”
The statement continued; “This requires, among other things, that all authorities must adhere to the limits of their constitutional powers, and that local authorities should not exercise the exclusive powers of the federal authorities, because that relates to the country’s sovereignty and unity, with the necessity of local authorities for regions or governorates not organized into a region exercising other powers, and taking into account the common powers between the authorities.” Federal and local.”
He pointed out that “as a result of its decisions taken to preserve the Constitution, the Federal Supreme Court is exposed to an internal and external media attack to discourage it from completing its constitutional duties towards the nation and the people. We believe that this attack is politicized and aims to harm the reputation of the Federal Supreme Court and target its legitimacy. It is considered an infringement on the independence of the judiciary, which requires... “Take all necessary legal measures to deter its failure.”
The Iraqi Constitution stipulates that “The Republic of Iraq is a single, independent, federal state with full sovereignty. Its system of government is republican, representative (parliamentary), and democratic, and this constitution is a guarantor of the unity of Iraq.”
On Wednesday, Iraqi politician Mishaan Al-Jubouri revealed that he was subjected to what he described as a “threat” by the President of the Federal Court, Jassem Al-Amiri, to drop his membership from Parliament, if he did not abandon the tripartite alliance.
The tripartite alliance is a political formation of the Sadrist movement, the Kurdistan Democratic Party, and the “sovereignty” alliance, which was formed after the past legislative elections with the aim of forming the government, before its disintegration after the Sadrists withdrew from the political process, so that the formation of the government became the “state administration” alliance.
Al-Jubouri was asked, in an interview with the local “I NEWS” station, who “sent him a letter threatening to drop his membership from the House of Representatives if he did not leave the tripartite alliance project,” where he replied, “It was the President of the Federal Court, Judge Jassim Al-Amiri, before he dropped my membership.”
