Voting on the budget schedules before approving the final accounts...a violation of the constitution[/size]
[size=45]The Council of Ministers presented the draft budget schedules law for the year 2024, and the draft did not include a report on the final accounts for the 2023 budget.
The government and the Ministry of Finance did not adhere to the decision of the Federal Court No. 190/Federal/2024 issued on 11/12/2023, which obligated them to submit the final accounts in accordance with the provisions of Article (62). /First) of the Constitution of the Republic of Iraq of 2005 and the provisions of the Federal Financial Management Law No. (6) of 2019, as amended.
The Federal Court previously ruled in favor of the Iraqi Communist Party in its lawsuit filed against the Prime Minister in addition to his job, in which it demanded the submission of the final accounts of the general budget annually and on the scheduled date.
On June 3, 2024, the House of Representatives voted on the schedules of the Federal General Budget Law No. (13) of 2024, despite not having seen the final accounts for the previous year, as well as the final accounts of the Emergency Support for Food Security Law.
The House of Representatives passed the draft formula despite this clear violation of the Constitution, the law, and the decision of the Federal Court, and despite the existence of deep disagreements within Parliament’s political blocs regarding the method of distributing the schedules and quotas allocated to each of the governorates. This means that the House of Representatives contributed to this violation and that it did not fulfill its constitutional role in monitoring the Government performance.
We affirm that not preparing the final accounts is a step that does not reflect the intention of establishing parliamentary work and financial management on sound foundations, nor does it reflect the processes of implementing the general budget in accordance with the law, while this reflects a lack of concern for public money.
We believe that these violations must stop and that the House of Representatives and the judiciary must fulfill their duty in the proper application of the articles of the Constitution.[/size]
