    Member of the Parliamentary Legal Committee, Raed Al-Maliki, revealed today, Tuesday (July 23, 2024), the advantages of amending the Personal Status Law, while stressing that this amendment represents an application of the provisions of the constitution, and a response to the needs of society and the desire of religious authorities.
    Al-Maliki said in a statement received by "Baghdad Today" that "the proposed law is in accordance with and conforms to the constitution and implements the provisions of Article 41 of the constitution, which states that (Iraqis are free to adhere to their personal status, according to their religions, sects, beliefs or choices, and this shall be regulated by law)", indicating that "the proposal gives the Iraqi the freedom to choose to apply the provisions of the Personal Status Law in force on him (Law 188 of 1959) or choose the provisions of (the Sharia Code in Personal Status Matters) that will be developed and approved by the Council of Representatives."
    He added, "The provisions of the Sharia Code will include two chapters, one for Jaafari jurisprudence and the other for Sunni jurisprudence, which will be developed by the Council of Scholars in the Shiite and Sunni Endowments Diwans in coordination with the State Council and in accordance with the well-known provisions of Shiite and Sunni jurisprudence," stressing that "the proposed law preserves the unity of the judiciary and does not create duplication in the courts. There will only be the provisions of Law 188 and the provisions of the Code, and the current courts will apply them according to what the person chooses when concluding his marriage contract."
    He continued: "The proposed law fulfills the demands of religious authorities since the time of the supreme authority of his time, Sayyid Mohsen al-Hakim, until today, regarding the necessity of not imposing the provisions of positive law on Muslims in Iraq and granting the person responsible the right to choose the provisions of his religion and sect in his personal status," noting that "the talk that this law will divide the Iraqi family is inaccurate and contrary to reality. What has the current law preserved for the family, given what we see today of the high rate of divorce, post-marriage problems, and the problems of the current law?"
    He stressed that "the proposed law is open for parliamentary discussion after the first reading and in accordance with the internal regulations. After reading it, communication will be made with various social and religious activities and observations and suggestions will be taken into account. It does not represent the opinion of a particular party or religious entity and enjoys the support and endorsement of parliamentary blocs and most segments of society."
    The representative concluded by saying, “We ask all representatives and representatives of religious authorities, pulpit preachers, Friday and congregational prayer imams, representatives of parliamentary blocs, and all academic, professional, and social activities to clarify these matters regarding the proposed law, as it represents an application of the provisions of the constitution and a response to the needs of society and the desires of religious authorities.”
