The head of the Federal Service Council concerned with the file of public service and employment in Iraq, Mahmoud Al-Tamimi, said in an interview with Al-Araby Al-Jadeed, which was followed by Al-Iqtisad News, that a large human mass in the public office constitutes a burden on the oil country’s budget, and he explained that 10% of his citizens work in the sector. government, while the Iraqis are more inclined to the government job as it is the most guarantee for them.
He explained that Iraq is without a law regulating the work of the service file and its administrative structures since 1960, while stressing the importance of reconsidering these structures due to conflicting powers and decisions, revealing at the same time the percentage of Iraqis working in the government sector, and indicating at the same time the existence of cooperation with Egypt in public service file.
This is the text of the interview with Al-Tamimi:
First of all.. What are the tasks and powers of the council and do you provide services to develop the performance of employees?
The powers of the Council were stipulated in its Law No. 4 of 2009 in Article 9/First, and it includes organizing the affairs of public jobs in Iraq in terms of appointment in government institutions, reappointment, setting up job structures and descriptions, proposing legislation for this file, and everything that would contact the public service directly or By participating with the sectoral authorities in accordance with the laws, especially the Ministries of Planning and Finance, as well as we are working to provide training, qualification and development services through the Development and Training Institute for Public Service, which is awaiting the enactment of a law of its own to regulate the role and powers granted to it, and we are proceeding in this direction and we intend to do it through specialized cadres In order to raise the quality and productivity of employees.
You said earlier that there is a problem with the structure of the administrative system in Iraq. Where does the defect lie and does it need reorganization or restructuring?
The decisions that regulate the administrative structures currently in force must be reviewed, especially since most of them are related to the Public Civil Service Law that was enacted in 1960 and it has become necessary to legislate a new law, and one of the requirements for success in management is to review the structures of government institutions, and we believe that this should be done every 5 Years to keep pace with the global development in administrative systems, which are witnessing leaps in management, organization and exploitation of resources. We have been assigned by the government to reconsider the structure of Iraqi government institutions in cooperation with Arab and international organizations, benefiting from the experiences of brotherly and friendly countries.
Likewise, we, as a council, believe that the most important problems that we suffer from come because of the legislative environment for the public service file, as it needs to be reconsidered, and the powers of each party concerned with this file are determined, and there are legislations that impede our work.
So, Iraq for 63 years without a law regulating the civil service and keeping pace with global developments in administrative systems, what are the implications of that?
A new law must be legislated to keep pace with the development of administrative systems globally and the existing material and human capabilities in the country. There was a governmental version submitted to Parliament and it was withdrawn from the current government to amend and mature it. Other legislation must also be issued that supports the file of public service, such as the laws of staffing and discipline of state employees. And canceling previous decisions dating back decades, and this is all one system, one part of which cannot be separated from the other.
The law that the government is currently considering will remove many problems, the most important of which is the issue of powers, as it is in the public service file scattered between the Service Council, the Ministries of Finance and Planning, the Financial Supervision Bureau, ministries, agencies and governorates, and each of these spending units has powers and conflicts sometimes occur in decisions taken, and the will of the Iraqi legislator turned towards the formation of an institution concerned with the public service file represented by the Federal Service Council to organize this process.
How do you read the slackness in the functional body that exists in Iraq, and can solutions be found, or is it too late?
There is a human mass that constitutes a burden on the state and the budget, and addressing the situation requires an administrative vision in each institution that exploits the existing resources by employing them in a manner commensurate with capabilities with the need to develop capabilities. There are countries that do not have natural resources and compensated them with existing human resources and achieved economic leaps.
How many job grades has the council supervised since its establishment in 2019?
The council was established at the end of the fiscal year in 2019, and after that there was no budget for the year 2020, and our first recruitment assignment was in the 2021 budget for the appointments of the Ministry of Health and it was very limited, then came the year 2022 in which there was no budget either.
The issue was limited to the issuance of the law on emergency support for food security and development, and we were assigned to file appointments for appointing the first three to colleges and holders of higher degrees (Master’s and PhD), with 43,000 job degrees out of the 74,000 that were completed by decisions from other parties.
Out of the total of 720,000 job degrees added to the 2023 budget, how much did you supervise as an entity in charge of the appointments file?
We have assignments in the newly legislated 2023 budget, such as managing the file of appointing minorities, reappointing in state institutions, completing the appointment of seniors and holders of higher degrees, in which our role, according to the emergency support law, was limited to the 43,000 job degrees that we referred to, while the rest were not assigned to us, and our role is done according to The budget confirms the mandate of the Service Council only.
The chaos of appointments after 2003 and the prevalence of nepotism in employment, how did they affect the structure of state institutions?
Every appointment that deviates from established laws and standards has a negative impact.
How do you view the issue of the lack of a clear database that includes all Iraqi employees?
The issue is on its way to being resolved through the job number platform project that the Ministry of Planning has adopted, and it has reached a very advanced stage in it, and it will show the total number of employees, their types, their scientific levels, and their capabilities, and this issue is very important, because every project that is planned needs accurate data to employ human resources in it In the best way and in its correct locations, and of course all the administrative apparatus in the country will benefit from it, including the Service Council.
The limited role of the private sector in providing jobs. Why does it continue and push Iraqis to trust government jobs exclusively, which continues to put pressure on the state?
Poor regulation of the relationship between the worker and the employer in the private sector is a fundamental problem. The current government has turned to it by enacting the Social Security Law for workers, as it provides protection for both parties, and we believe that its implementation will cause a quantum leap that encourages Iraqis to go to the private sector in search of jobs. Currently, they go to the sector. The government job because it is more secure and stable, and its income is fixed, and what is required is to transfer the privileges of the government job to private sector jobs, and this is what the Social Security Law for Workers can work on.
10% of Iraqis work in the government sector, and this is a very high percentage, while it does not exceed 2% in developed countries, and the private sector in Iraq has great opportunities, as the state is open to implementing many important and strategic projects, including the development road and cities project industry that is still being built.
There is a surplus of graduates from the Faculty of Pharmacy and Dentistry, amounting to 30 thousand. Why does a surplus appear in specializations and a scarcity in others, despite the need of the labor market?
It must first determine the state’s need on the one hand, and the market on the other hand, for certain jobs, to meet this need through the two options of increasing employment in it or opening colleges and institutes to provide graduates to cover the demand, and in return the shrinking of colleges and institutes in the specializations that are less in demand, and this depends on the data provided by the ministries requesting jobs, For example, the Ministry of Health needs specializations from the nursing and health cadres within its current departments or the projects that are opened and according to the jobs that are allocated.
The government addressed the ministries and agencies more than a month ago to provide them with data to maneuver between employees and make transfers in human resources from a department that has an excess of numbers and specializations to another that has a scarcity in order to bridge the shortcomings and put human capabilities in their rightful places.
There are complaints about the limited capabilities of doctors and nursing staff who have caused health problems for patients that have reached the level of deaths. How are these appointed?
The appointment of graduates of medical colleges takes place in accordance with Law No. 6 of 2000, which obligates the state to appoint its graduates in health institutions, and they are subject to the law of medical progression to refine their skills and add other new skills to them, and there are those whose capabilities remain limited, and there is a procedure that must take its real role represented in the evaluation form that is given to departments In light of it, an evaluation is developed for each employee, and unfortunately it is still more formal than objective, and on its basis it is supposed to determine the qualification of the employee, either to stay in the same job title, upgrade him, or retrain him to develop his skills. To raise their capabilities and skills, and this is a procedure in force in many countries, and it must take a greater role in Iraq.
Do you think that the Iraqi employee is productive to an acceptable level, or is his development a duty to raise his efficiency and productivity?
The topic is relative and directly related to the management style and the extent of its success in each department and in the light of the employee's potential and the development of his performance.
You signed a memorandum and agreement with the Egyptian and Jordanian sides in the last two months. What is their content?
With the Egyptian side, we signed a memorandum of understanding related to the public job file in general and the administrative organization. The brothers in Egypt have made important strides in the field of human resource management and they have the central apparatus for organization and administration, which is one of the ancient institutions, and it is possible to benefit from their experiences in Iraq, and in return they were impressed by the experience of the Federal Service Council In the file of recruiting the first and holders of degrees and they asked for our help in terms of using modern systems and databases.
As for the Jordanian side, we have signed an agreement for the exchange of information and knowledge in employment and public service with the Service Bureau there, which is one of the important and long-standing institutions. They have agreements in the field of training and development with solid international and European organizations, and it is possible to benefit from experiences and agreements with Arab countries as one of the tools of communication.
