    The Iraqi Minister of Justice, Khaled Shwani, announced that the problem of agricultural land in Kirkuk is one of the important problems and one of the points they are working on, adding: "We will solve it with God's help."[/size]
    [size=45]On Wednesday (November 9, 2022), the Minister of Justice in the Iraqi federal government, Khaled Shwani, had a tour during which he inspected the directorates affiliated with the ministry, starting with a visit to the Reform Directorate.[/size]
    [size=45]Khaled Shwani talked about the purpose of his visit in Baghdad, Halkut Aziz, saying: "We started from the Reform Directorate, because it is one of the large and very important departments of the Ministry of Justice, and there is a lot of talk about it in the media and public opinion."[/size]
    [size=45]On the issue of agricultural land in Kirkuk governorate, which has disputes over its ownership and its issue is linked to the Ministry of Justice, Khaled Shwani said that “this file is one of the important files, and since 2012 a decision has been issued on it by the Federal Council of Ministers, but unfortunately the Iraqi Ministry of Justice and Ministry of Agriculture did not work.” With the decision, to the extent that the courts of Kirkuk and other carved out areas do not work according to it.”[/size]

    [size=45]It is noteworthy that the governorate of Kirkuk is covered by Article 140 of the Iraqi constitution, where the first paragraph of the article states that the executive authority shall take the necessary steps to complete the implementation of the requirements of Article (58) of the Law of Administration for the State of Iraq for the Transitional Period with all its paragraphs.[/size]
    [size=45]While the second paragraph of the constitutional article states that the responsibility entrusted to the executive authority in the transitional government stipulated in Article (58) of the Iraqi state administration law for the transitional period extends and continues to the executive authority elected under this constitution, provided that it is fully accomplished (normalization, census and ends By a referendum in Kirkuk and other disputed areas to determine the will of their citizens) within a maximum period of the thirty-first of December in the year two thousand and seven.[/size]
    [size=45]The Iraqi Federal Supreme Court had announced in 2019 that it “found that Article 140 of the Constitution of the Republic of Iraq of 2005 mandated the executive authority to take the necessary steps to complete the implementation of the requirements of Article 58 of the Law of State Administration for the Transitional Period with all its paragraphs aimed at achieving justice in the areas that were subjected to Changing the demographic situation through deportation, exile and forced migration, which is still in force in accordance with the provisions of Article 143 of the Constitution,” and found that “these steps (which Article 140 stipulate) have not been completed and that some of them have not been taken, and the goal remains to establish and legislate Article 140 of the Constitution. The constitution is required and obligatory for everyone to implement,” stressing that “the date set for implementing Article 140 of the constitution has been set for organizational matters and to urge those concerned to implement it, and it does not affect the essence of the article and the achievement of its objective.”[/size]
