In a move that has brought back the wide political controversy to the scene; the House of Representatives is presenting the "general amnesty" law for the first reading during its session today, Wednesday. This law, over which disagreements have been escalating for years, seems that it will not see the light of day except with an unclear political consensus on the horizon. Representative Moeen Al-Kazemi told Al-Sabah: "One of the points of contention in the law is that some want to reinvestigate 50,000 convicts, and others want to redefine the accused (participant in terrorism)", stressing that "these matters are not possible in a controversial law such as the general amnesty", adding that "all blocs want to pass a law that pardons prisoners and convicts whose hands are not stained with the blood of Iraqis, and there are many of them who have completed a large part of their sentences". He explained that "including them in the general amnesty comes to reunite them with their families and end their routine and administrative suffering that has lasted over the past years, and to reduce the number of prisoners in correctional centers." For his part, member of the parliamentary legal committee, Raed Al-Maliki, told Al-Sabah: “The law replacing the penalty with financial amounts has been stopped in parliament by some parties and political blocs (Sunnis) who believe that this law affects the approval of the general amnesty law,” indicating that according to his personal and legal vision, the previous objection is incorrect, and that “the two laws can run in parallel without affecting each other.” He pointed out that “the country cannot remain without amnesty laws or replacing negative penalties with financial amounts,” stressing that “there are people who deserve the opportunity for amnesty and release from prison, especially those who commit minor crimes. However, the major political dispute over including terrorist crimes in the amnesty remains the main obstacle.” He stressed that "the problem with the law is not in the amnesty itself, but in the crimes classified as terrorist," and explained that "the general amnesty law is being dealt with in a political manner, which makes it difficult to predict its passage," indicating that "the suspension of the replacement law may continue, but if things continue as they are, demands may be made to include it again," noting that "the positions are fixed on not including those involved in terrorism, financial and administrative crimes, thefts, and drug trafficking, whether in amnesty or replacement," and Al-Maliki concluded his speech by pointing out that "the calculations of political blocs and elections may spoil some cases and take them off the right track." As for the Chairman of the Board of Directors of the "Justice Network for Prisoners," Shawan Saber Mustafa, he rejected the legislation of a special or general amnesty law, considering it interference by the executive and legislative authorities in judicial matters. Mustafa told Al Sabah: “The constitution stipulates the necessity of separation of powers, and the enactment of the two laws completely cancels what the constitution states,” indicating that “the position of (execution judge) can be created, who visits prisons and studies the conditions of prisoners, and can release any prisoner instead of enacting these two laws.”
