    The Ministry of Agriculture announced, on Tuesday, three legislations that prohibit the bulldozing of orchards or the removal of trees. While it referred to the measures taken against those who encroach on orchards and agricultural lands, it clarified the legal contexts related to converting agricultural lands into service buildings.
    “There are two laws to prevent the uprooting of orchards or the removal of trees in general: the first is the Forests and Trees Law No. 30 of 2009, as well as the Environmental Protection and Improvement Law No. 27 of 2009, in addition to Cabinet Resolution No. 50 of 2016, which includes the prohibition of the expropriation of agricultural lands and the uprooting of trees and orchards,” said the ministry’s advisor, Mahdi Al-Qaisi, explaining that “according to these three laws, no person or entity may exceed and uproot trees, whether inside or outside cities.”
    Al-Qaisi added that “changing the type of land is protected by laws, so if there is a need to change the type of land, there are mechanisms and procedures that follow changing the type of land within the recognized contexts, otherwise it is considered a violation that is punishable under the applicable laws and instructions issued with these laws or legislations,” noting that “when the Ministry of Agriculture notes a violation on an orchard or on agricultural lands, it informs the executive authority (the governorates) represented by the Directorates of Agriculture, considering that they are administratively and technically affiliated to the governorate under the Governorates Law.”
    He added, "There is a committee in the General Secretariat of the Council of Ministers that looks into allocations when agricultural land is needed to build, for example, a hospital, school or factory, and it takes into account the legal contexts of the Ministry of Agriculture and other entities that have a relationship with the land, including the Ministries of Defense, Interior, Antiquities and Oil," explaining that "all of these ministries have a relationship with land possession to give their opinion regarding changing the type of land or keeping it within the laws and instructions in force that were enacted to preserve the environment and agriculture, as well as preserve the identity of the country."
    He pointed out that "the uprooting of trees and orchards and the expropriation of agricultural land may affect several factors, including the country's economy, social life, and the environment," noting that "all of these factors are taken into consideration by the main committee for the purpose of converting the type of land to the public interest and according to the existing laws that prohibit the removal of trees and encroachment on the nature of agricultural land."
