    The Metro Center said, on Tuesday, that the decisions of the committee formed by the Ministry of the Interior to follow up on the so-called degrading content, empty Article 38 of the Iraqi constitution, which guarantees freedom of opinion and expression in all ways and means, of its content, and even demands the government to implement all mouth-gagging penalties that were issued during the time of the dictatorial regime. New, more severe penalties are added to it.

    The center stated in a statement, which “NAS” received a copy of, (February 14, 2023), “While Article 38 of the Iraqi constitution guarantees freedom of opinion and expression in all ways and means, ministries and agencies in the Iraqi government resort to issuing decisions and regulations that empty this basic constitutional article from Its content, and even demands the application of all mouth-gagging penalties that were issued during the dictatorial regime and contained in the Baghdadi Penal Code No. 111 of 1969, and to add to them new, more severe and harsh penalties.  
      
    He added, "After the decisions of the committee formed by the Ministry of Interior to follow up on the so-called negative content, under the title (report), according to which a number of content makers were arrested, and prison sentences ranging from 6 months to two years were issued."  
      
    And he continued, “And the spokesman for the Ministry of the Interior came out proud of us that the number of reports about the so-called degrading content, which the ministry has reached so far, has reached 95 thousand, meaning that we have returned to the secret informant and malicious cases, as long as there is no legal definition that cannot be interpreted for (content). bearish)".  
      
    He explained, "It is sad that the Bar Association comes out to us, threatening lawyers to cancel their names from the association's register and prevent them from practicing the legal profession. Every lawyer declares that he has defended a member of the so-called inferior content, while the law allows even the most notorious criminals, murderers and thieves to appoint a lawyer for defense." about them.”  
      
    On the other hand, he pointed out, "On the other hand, the Media and Communications Commission is preparing to issue a regulation, calling on it to apply the Iraqi Penal Code 111 of 1969, in addition to that applying some provisions of the Anti-Terrorism Law and other punitive legal texts, to everyone who harms the state, its entities and symbols, and even those who harm syndicates and federations." Regulation, as well as requiring influencers on social media to register with the Media and Communications Authority, obtain official approvals, and pay financial fees before publishing.  
      
    And he stated, “The regulation also imposes various financial and punitive fines and does not allow publishing what upsets the mood of senior leaders or criticizing the current “democratic” system and its “constitutional” institutions, as well as imposing the commission on the owners of funded content to pay a percentage of the funding value to the media and communications commission.  
      
    He pointed out that "one of the articles of the regulation included the criminalization of any person who incites to boycott the elections, although this is a natural right for every citizen in the democratic system, and that the regulation is intended to turn into a law that gives the Council of the Media and Communications Commission, which is composed of political parties that came with quotas, powers Absolute and extensive censorship to control the published content.  
      
    He explained, "The list, consisting of 17 chapters and 36 punitive articles, does not exist even in the countries farthest from democracy, and before that, the first reading of the Information Crimes Law took place, which in many aspects threatens freedom of opinion and expression, and it became clear that the government seeks to suppress Freedoms and suppression of voices opposing its approach, with flimsy pretexts that appear to be good and inwardly threaten freedom of opinion and expression and stifle breath.”  
      
    And he added, "The Metro Center launched a year ago an awareness campaign against misinformation, false news and information, and not through arbitrary decisions and laws, to limit freedom of opinion and expression."  
      
    He stressed that "the Metro Center rejects this approach and believes that these decisions and regulations pose a real threat to the democratic system and seriously threaten freedom of opinion and expression, and calls on public opinion and all those concerned with defending human rights and freedom of opinion and expression to stand against such decisions and regulations that restrict public and private freedoms." Organizations specialized in freedom of opinion and expression, and organizations defending human freedom and rights, are organizing a serious campaign to stand against such abuse of human rights and freedom to express their opinions.   
      
    The Metro Center for the Defense of Journalists' Rights was established in August 2009 with the efforts of a group of journalists and human rights defenders. The center issued 11 annual reports on the conditions of press freedom in the Kurdistan region of Iraq.
