{Local: Al Furat News} The Court of Cassation approved the renewal of contracts for telecommunications companies operating in Iraq .. Continued
The Baghdad / Al-Karkh Court of Appeal ruled on December 23 that there was no legal impediment to renewing the licenses of the mobile phone company.
In a document issued by it, the court considered that the Media and Communications Commission is independent and bears sole responsibility for licensing and regulating media and communications services in Iraq, and the Council of Ministers has nothing to do with this issue.
And she continued: "There is no legal impediment to renewing the licenses of the mobile phone company, based on the decision of the Board of Trustees, which was taken in the 13th session on 11/24/2020."
The court denied that the Prime Minister has the power to approve the renewal of mobile phone licenses, considering that the renewal request is subject to negotiations, and the requirement that all the terms and conditions set forth in the original contract be met, and this is not fulfilled.
The court's decision obliges the licensed companies to pay all the financial dues and debts they owe, before signing the contract, provided that it does not exceed the period specified in the Deficit Financing Law.
On November 15, the Presidency of the Baghdad / Al-Karkh Second Appeals Court announced the revocation of the renewal of licenses for mobile phone companies, against the backdrop of a lawsuit filed against it.
It is noteworthy that the mobile phone licenses were concluded in 2007 and expire in 2022, while there is no obligation in their contracts to renew, but the renewal request is subject to negotiations, according to the Iraqi judiciary.
