The Iraqi Prime Minister, Muhammad Shia al-Sudani, confirmed that the outstanding issues with the Kurdistan Region are being resolved successively within the ministerial curriculum of the current government.
On Friday (February 10, 2023), Al-Sudani said, “There is a consensus on the necessity of approving the oil and gas law, given its importance to all components.”
It is noteworthy that the Iraqi Foreign Minister, Fouad Hussein, indicated in his speech during the meeting of the Iraqi delegation today in Washington with the American Chamber of Commerce, that “the oil and gas problem between Erbil and Baghdad will be resolved through the issuance of the oil and gas law,” stressing the need to solve this issue within “ 6 months".
To discuss the issue of oil and gas, “a delegation from the Kurdistan Regional Government will visit Baghdad in the near future,” according to Iraqi Foreign Minister Fuad Hussein.
In his interview with Sky News, Al-Sudani indicated that "the outstanding issues with Kurdistan are being resolved successively within the ministerial curriculum of the current government."
He pointed out that there is "a draft of the oil and gas law being drafted by the Federal Ministry of Oil and the Ministry of Natural Resources in the Kurdistan Regional Government, to be presented later to the Council of Ministers and Parliament."
The absence of an oil and gas law is one of the most prominent problems facing the oil and gas sector after 2003. Three drafts of the bill have been sent to parliament since 2007, but differences between political parties prevented it from being passed, prompting the Kurdistan Region to issue its own oil and gas law.
Article 112 of the constitution stipulates in its first paragraph, that “the federal government shall manage the oil and gas extracted from the current fields with the producing governments of the regions and governorates, provided that its revenues are distributed equitably in proportion to the population distribution throughout the country, with a specific quota for the affected regions.” Which was unfairly deprived of it by the previous regime, and which was damaged afterwards, in a way that ensures balanced development for the different regions of the country, and this is regulated by law.”
And in the second paragraph of the same article, it was stated that the federal government and the governments of the producing regions and governorates together draw up the strategic policies necessary to develop the oil and gas wealth, in a way that achieves the highest benefit for the Iraqi people, adopting the latest techniques of market principles and encouraging investment.
On (February 15, 2022), the Iraqi Supreme Federal Court issued a decision, describing the oil and gas law of the Kurdistan Region as “unconstitutional,” demanding the Kurdistan Regional Government to hand over the revenues from the oil produced to the federal government, a decision rejected by the Kurdistan Regional Government, which is subject to various pressures. since then.
